Sub:- Review of guidelines regarding re-employment/re- engagement of Superannuated officials in Public Sector Undertakings under the Administrative control of Ministry of Railways.

The issue of Re-employment/Re-engagement of superannuated officials in PSUs has been reconsidered by Railway Board and a set of guidelines has been approved for compliance by all the Public Sector Undertakings under the administrative control of Ministry of Railways currently and will also apply to others which may be formed hereafter. The consolidated guidelines on the above subject in supersession to the earlier instructions on this subject are being issued.

I. RE-EMPLOYMENT:

Re-employment of retired government personnel in the PSUs should not be a matter of routine as this hampers the employment potential of the younger generation. However, the expertise and experiences available with the retired government personnel should be made use of in deserving cases. It should be specifically checked that the credentials of the retired personnel match the job requirements. Accordingly, keeping in view the special business needs of Railways PSUs, superannuated personnel from Railways, other Government departments and PSUs who have crossed normal age of retirement may be re-employed subject to the following:

i) Re-employment beyond the age of superannuation should not be done as a matter of routine and should be based on the merits of each individual case. Non-technical/non-professional employees should not be re-employed.

ii) Re-employment will be resorted to where specific expertise is not readily and adequately available within the company and serving government officers are not willing to join on deputation. Efforts should be made through wide publicity for getting experts on deputation or other means.

iii) When a project is in midstream and withdrawal of the expert who is retiring will adversely affect completion of the project. This should be resorted to only in exceptional cases. Normally arrangement should be made by the company in time so that retirement of an individual does not affect the company’s business/completion of the project. Care should be taken that only officers have sufficient time before retirement should be posted on new projects so that necessity for re-employment for completion of the project does not arise.

iv) Re-employment will be governed by the following provisions:

a) Below SAG (Scale up to 18300/-)

- Up to 65 years – Full powers to Board of Directors

- Beyond 65 years- Full powers to Railway Board

v) Only officers with good conduct and integrity should be considered for re-employment. Details should be checked up from concerned Administrative Ministry/Department.

vi) With the permission for re-employment, the PSUs may review requirement of consultants, contract appointments, advisers, etc.

vii) Approval of individuals for re-employment should invariably be from the Board of Directors of the company irrespective of the level.

viii) PSUs may be permitted to have expert manpower of serving personnel on deputation for projects in India and abroad with the consent of the concerned Board Member for a period of up to 30 days.

ix) Retired and re-employed persons should not be sent abroad unless the prior approval of Railway Board has been obtained.

II. RE-ENGAGEMENT:

i) Retired personnel can be engaged only on specific assignments as consultant.

ii) Engagement of consultants should be need based for specific assignments and for specific duration.

iii) Consultants shall not be allowed to take regular work of the companies.

iv) Consultant shall not undertake work that involves entering into financial commitments for exercising powers or matters, which are likely to bind the company.

v) Consultants shall be drawn out of a panel for this purpose. BOD of the company shall approve panel of consultants. Consultants may be engaged without prior approval of the panel of consultants by the Railway Board as per following delegation of powers:

a) Up to age of 62 years - By Managing Director of the PSU

b) from 62 years to 65 years - By BOD of PSU

c) 65 years and above - By Railway Board

vi) The panel of consultants approved by PSUs and the cases for re-engagement beyond 65 years are to be submitted to Railway Board (Planning Directorate).

vii) Only persons who are clear from vigilance angle should be engaged.

viii) Emoluments payable to retired government officials/PSUs officials may be such that the total emoluments drawn together with the pension should not exceed the last pay drawn (Basic Pay + DA). The fee payable to non-officials consultants may be decided by the PSUs.

ix) The system of engaging consultants on retainership basis i.e. without specifying any specific assignment for a specific duration shall not be permitted and it should be discontinued with immediate effect.

PSUs will advise the details of re-employed/re-engaged officials. The details should be submitted to Planning Directorate immediately and at the beginning of each financial year. These details may also be put up by the PSUs for information of their Board for review during BOD meetings.
